Commercial Terms & Conditions
It Brings Art specializes in the design, production, and supply of merchandising and wholesale gift items. To establish clear standards and protect the interests of both parties, the following commercial terms and conditions apply to all orders:
Production and Lead Times
- Productions on demand have an estimated manufacturing lead time of 4 to 6 weeks. This period is indicative and may be extended due to factors beyond the control of It Brings Art, such as holidays, production delays, import/export procedures, customs processes, among others.
- The production of an item under order may result in quantity variations of up to +10% or -10% from the initial order. It Brings Art reserves the right to deliver and invoice for the total quantity produced, provided it does not exceed +10% of the order.
Transport Management and Responsibility
- It Brings Art is not responsible for delays or issues caused by transport agencies.
- By default, It Brings Art will arrange transport to ensure order delivery, unless the client requests direct management through a transport agency of their choice. In such cases, It Brings Art will assist in delivering the merchandise to the point agreed upon with the client’s designated agency.
- The cost of standard transport will be fully borne by the client unless specific conditions are agreed upon for the client.
- Under no circumstances will It Brings Art cover the costs of extraordinary or expedited transport, even in the event of production delays.
Variations in Delivered Quantities
- Delivered quantities of a product may vary by +3% or -3% from those indicated on the delivery note. It Brings Art will neither reimburse nor invoice differences within this range.
- For items delivered in batches, It Brings Art reserves the right to round the delivered and invoiced quantity to the nearest multiple of the batch quantity relative to the ordered quantity.
Variations in the Product
- Due to manufacturing processes, products may exhibit minor variations between production runs. These differences are considered normal within industry standards and will not constitute grounds for claims.
- It Brings Art may not deliver an item that was available at the time of order placement if it has been discontinued after the order was made.
Issues Upon Order Receipt
- Clients must inspect the order upon receipt and report any issues related to the shipment within 7 calendar days of delivery.
- Claims must be supported by documentary evidence (photographs, videos, etc.) for evaluation.
- After the 7-day period, It Brings Art will not accept claims, as it will no longer be possible to process insurance claims with the transport agency.
Precedence of These Terms
- These terms and conditions take precedence over any prior or subsequent communication, whether verbal or written. They shall be binding unless a specific agreement is signed by both parties.
Additional Considerations
- Custom Orders: Custom-made orders and/or those created upon specific client requests cannot be modified or canceled once the production process has begun.
- Payments and Invoicing: Payments for orders must be made according to the terms previously agreed upon with It Brings Art. In the event of payment delays, It Brings Art reserves the right to withhold the delivery of future orders.
- Force Majeure: It Brings Art will not be held responsible for non-compliance due to force majeure events, such as strikes, natural disasters, pandemics, armed conflicts, government restrictions, or any other event beyond its control.
